Skater Code of Responsibility + Liability Waiver

SKATERS CODE OF RESPONSIBILITY

Ice skating is an inherently dangerous and physically demanding athletic ability. Please abide by the following Code and help make Winter Village a wonderful experience for everyone.

•You must have a Winter Village skate ticket to enter the ice rink.
•You must wear ice skates to enter the ice rink.
•Read and abide by all signs.
•Follow announcements and obey the instructions of the skate guards.
•Children under 18 must be always accompanied by an adult.
•Cell phones, headphones, cameras, and pocketbooks are not permitted on the ice. Coats must be worn or checked at Bag Check.
•Food and drinks are not permitted on the ice, or in the skating areas.
•Skating while under the influence of drugs or alcohol is strictly prohibited.
•No sitting or climbing on the railings.
•No carrying a child while ice skating. This is very dangerous for the child.
•No more than two people may hold hands while skating.
•Do not congregate at the railings or block the entrances/exits.
•The center of the ice rink is for skating lessons and figure skating.
•Spins, jumps, and backwards skating are not permitted.
•Please report any injury to a Winter Village staff member.
•Skate respectfully.
•No abusive, aggressive, abrasive, or disorderly conduct, which may include weaving, pushing, and power stopping.
•If you are skating in any manner that endangers your fellow skaters, you may be warned and/or asked to leave the ice. Winter Village staff members reserve the right to permanently ban aggressive skaters from The Rink.

For security reasons, online skating reservations require the name of each person in your party. If fake or repeat names are used, your order may be cancelled, and you will be charged a cancellation fee. Failure to comply with this policy could result in being permanently banned from The Rink.

If you do not show up for a skate reservation and make no attempt to notify us in advance, this constitutes a “no-show”. Repeated “no-shows” are grounds for being permanently banned from The Rink.

ASSUMPTION OF RISK, RELEASE OF LIABILITY
& WAIVER OF CLAIMS AGREEMENT

In consideration of being allowed to use the facilities and participate in ice skating, bumper cars on ice, and/or other activities (collectively the “Activities”) provided by Rink Management Services, Inc. (the “Host”), the Participant, and the Participant’s parent(s) or legal guardian(s), do hereby agree, to the fullest extent permitted by law, as follows:

a)    TO WAIVE ALL CLAIMS that they have or may have against the Host, Bryant Park Corporation (“BPC”), the Sponsors of Winter Village (“WV”), the City of New York (“NYC”), and their respective owners, affiliates, employees, and/or agents arising out of the inherent risks of participating in the Activities;

b)    TO ASSUME ALL RISKS INHERENT IN PARTICIPATING IN THE ACTIVITIES, which inherent risks expressly include, but are not limited to, bodily injury and/or death arising from falling on ice for any reason and/or due to imperfections in the ice surface, due to collisions with other skaters, objects, and/or the dasher boards, and due to ice skates which do not fit properly and/or which have imperfections in their blades.  If participating in bumper cars on ice, said inherent risks also include, but are not limited to, bodily injury and/or death arising from collisions with other bumper cars;

c)    TO RELEASE the Host, BPS, WV, NYC and their respective owners, affiliates, employees, and/or agents, from all liability for any loss, damage, injury, or expense forming the basis for a claim and/or cause of action that the Participant [or his/her parent(s) or legal guardian(s)] may suffer, arising out of the inherent risks of participation in the Activities.  

Personal Responsibility

The Participant and his/her parent(s) or legal guardian(s) certify that Participant has no physical or mental condition that precludes him/her from participating in the Activities and that he/she is not participating against medical advice.  

The Participant and his/her parent(s) or legal guardian(s) understand that Participant’s participation in the Activities is voluntary and further understand that they have the opportunity to inspect the Host’s equipment and facilities before any participation.

The Participant and his/her parent(s) or legal guardian(s) understand that Participant is obligated to follow the Skaters Code of Responsibility and any posted Rules and that he/she can minimize his/her risk of injury by doing so and through the exercise of common sense and by being aware of his/her surroundings.

If, while participating in the Activities, the Participant and/or his/her parent(s) or legal guardian(s) observe any unusual hazard or condition, which they believe jeopardizes Participant’s personal safety or that of others, Participant and/or his/her parent(s) or legal guardian(s) will remove Participant from participation in the Activities and immediately bring said hazard or condition to the attention of the Host.

The substantive laws of the State of New York shall govern this Agreement.  To the extent that any portion of this Agreement is deemed to be invalid under the law of the State of New York, the remaining portions of the Agreement shall remain binding and available for use by the Host and its counsel in any proceeding.
